We always advise our clients if, in our view, a matter can be more efficiently resolved by a less costly alternative dispute resolution procedure (ADR), such as mediation or arbitration. Mediation is a talking and listening procedure, in front of a disinterested mediator, aimed at achieving an agreed settlement. Arbitration is an abbreviated trial, with relaxed rules of evidence, to a disinterested party or group. Sometimes, such alternative procedures can be useful (and far less costly than a court trial) when it comes to achieving particular objectives. Sometimes they are not worth the time or the risk.
